2024 Employment Equity Reporting: What’s Ahead and How to Prepare?

The Department of Employment and Labour (“DEL”) has commenced national stakeholder engagement roadshows to prepare organisations for the upcoming Employment Equity (“EE”) reporting season. Among the key focus points addressed in the roadshow sessions, are updates regarding the upcoming reporting season and updates on the status of the highly anticipated EE amendments.

Status of the EE Amendments: Who needs to Report

In a recent statement by DEL Deputy Director, Masilo Lefika, stakeholders were informed that “a proclamation notice for commencement date is still pending”. This announcement carries significant implications for designated employers in the 2024 EE reporting cycle.

The EE Amendment Act of 2022, which was recently gazetted, exempts employers with fewer than 50 employees from compliance with statutory obligations, including the requirement for annual reporting. However, based on the indication by the DEL, it appears that the current compliance requirements will remain in effect for the 2024 submissions. Consequently, in addition to large employers with 50 or more employees, smaller employers previously classified as designated due to revenue criteria will still be required to submit their annual reports to maintain EE compliance

Risk of Non-Compliance

The reporting window will run from the first working day of September 2024 until 15 January 2025. Designated employers who fail to report will risk facing financial penalty as outlined in schedule 1 of the Employment Equity Act. Moreover, non-compliance will affect an employer’s ability to recognise points under the Management Control pillar of the B-BBEEE scorecard, as evidence of reporting compliance is a statutory requirement for verification.
